    Terms and Conditions of Sale

    Article 1: Scope and Modification of the General Terms and Conditions of Sale

    These general terms and conditions of sale apply to all orders placed on the website www.mafermeminiature.com.
    EI Alexandre PIETERS reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in force on the day of the order will be applied to each order.

    Article 2: Product Availability

    Our product offers and prices are valid as long as they are visible on the site, within the limits of available stock. In the absence of product availability, EI Alexandre PIETERS undertakes to inform the buyer.

    Article 3: Order Validation and Electronic Signature (Law of March 13, 2000 on electronic signatures)

    Any user of the site who does not have a customer account must create one before placing their order.

    In all cases, the online provision of the credit card number and the final validation of the order will constitute proof of the entire order in accordance with the provisions of the law of March 13, 2000 and will render the sums committed by entering the items appearing on the order form due and payable.
    This validation constitutes a signature and express acceptance of all operations carried out on the site.
    However, in the event of fraudulent use of their credit card, the customer is invited, upon noticing such use, to contact EI Alexandre PIETERS.

    Article 4: Prices

    Prices are indicated in euros, all taxes included. They take into account the VAT applicable on the day of the order. These prices do not include processing fees (postage, packaging, and parcel preparation according to the amount in force).
    EI Alexandre PIETERS reserves the right to modify its prices at any time but undertakes to apply the rates in force that were indicated to you at the time of your order.

    Shipping is free for deliveries in mainland France from 249 euros.

    Deliveries within the European Community:
    For any delivery within the European Community, the price of the products and shipping costs include the VAT applicable in France on the day of the order.

    Deliveries outside the European Community:
    For any delivery outside the European Community, the price of the products and shipping costs do not include the VAT applicable in France.

    Article 5: Ordering and Payment Methods and Security

    Any order placed on the website www.mafermeminiature.com is deemed firm and final, subject to the provisions relating to the right of withdrawal.

    You can make payment by:

    Credit Card

    Payment is made on Shopify's secure banking server. This means that no banking information concerning you transits through the Ma Ferme Miniature site. Payment by credit card is therefore perfectly secure; your order will be registered and validated upon acceptance of payment by the bank you have chosen.
    Your credit card details are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment is made directly to the bank. EI Alexandre PIETERS has no access to these details and does not store them on its servers. This is why they are requested again for each new transaction on our site.

    PayPal

    You use your PayPal account directly to pay for your order. Your order will then be registered and validated upon transfer to our PayPal account.

    Alma (2/3/4x)

    Alma's credit service is offered for the settlement of purchases and the execution of payment, provided that the person purchasing the goods or services through Alma ("Buyer") accepts the multi-payment or deferred payment agreement.

    Fees may be charged by Alma.

    Any refusal by Alma to grant multi-payment or deferred payment may result in the termination of the purchase contract for the goods or services ("GTC"), unless the Buyer agrees to pay the purchase amount in cash.

    In the event of termination of the GTC, the multi-payment or deferred payment agreement will be automatically terminated. In the event of withdrawal from the multi-payment or deferred payment solution used for your payment, the GTC will be automatically terminated, unless you pay the amount of your purchase in cash through Alma. If the product has already been shipped to you, you must return it within the maximum period provided in these GTC.

    Retention of title clause
    Products remain the property of EI Alexandre PIETERS until full payment of the order by EI Alexandre PIETERS.

    Default of Payment
    EI Alexandre PIETERS reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is ongoing.

    Article 6: Delivery Methods and Delivery Times in Mainland France

    Products are delivered to the delivery address you provided during the order process; we will not be responsible in case of delivery to the wrong location.
    Our parcels are sent by Mondial Relay or by carrier. The delivery time is 7 to 10 days for our products in stock and 30 to 60 days for our custom-ordered products.

    Claim:
    Goods always travel at the recipient's risk. If the package shows signs of damage upon delivery, open it in the presence of the delivery person to note any damage if necessary and make reservations on the shipping slip.
    You must declare the damage within 48 hours by registered mail to the carrier and inform us of the dispute by writing to contact@mafermeminiature.com

    Article 7: Responsibilities

    EI Alexandre PIETERS cannot be held responsible for the non-execution of the concluded contract due to a force majeure event, and in particular in the event of a total or partial strike of postal services, carriers, and disasters caused by floods or fires.
    Similarly, EI Alexandre PIETERS's liability cannot be engaged for all inconveniences or damages inherent in the use of the Internet, particularly a service interruption, external intrusion, or the presence of computer viruses.

    Article 8: Right of Withdrawal

    Return procedure
    In accordance with article L.121-20 et seq. of the Consumer Code, you have a period of 14 working days from the date of delivery of your order to return any item that does not suit you, in its original packaging and in NEW condition, suitable for resale, and request an exchange or refund without penalty, with the exception of return shipping costs.
    ATTENTION: No withdrawal will be accepted if the returned product is unfit for resale. Therefore: - The product must be returned in perfect condition, in its original packaging, unopened, unsealed, undamaged, unmarked, etc. -
    Otherwise, the product will be returned to you, at your expense.

    Processing your return for withdrawal: After receipt and acceptance of your package by our services, depending on the nature of the product, available stock, and your wishes, we will offer to reship an exchange product of equivalent value.

    Otherwise, a credit note will be credited to your customer account within 48 hours of receiving your package. It will correspond to the amount of the returned products. If you have chosen to be reimbursed, a check for the amount of the returned products will be sent to you within 15 days of acceptance of your return.

    For personalized products, they will not be returned or exchanged.

    The same applies to second-hand products; their condition cannot be questioned if the defect is visible in the photos.

    Return shipping costs for withdrawal:
    Return shipping costs in case of withdrawal remain the responsibility of the customer.

    Article 9: Provisions of the "Data Protection Act"

    At any time, "you have the right to access, modify, rectify, and delete data concerning you (Article 34 of the "Data Protection Act" of January 6, 1978).

    Article 10: Intellectual Property
    All elements of the www.mafermeminiature.com website, including the underlying technology, are protected by copyright, trademarks, or patents.
    They are the exclusive property of EI Alexandre PIETERS.

    Article 11: Dispute Resolution

    This contract is governed by French law.
    In the event of a dispute, EI Alexandre PIETERS will endeavor to find an amicable solution.
    Failing an amicable agreement, the consumer has the possibility to free of charge contact the consumer mediator to whom the professional belongs, namely the European Mediators Association (AME CONSO), within one year from the written complaint sent to the professional.

    Contacting the consumer mediator must be done:

    - either by completing the form provided for this purpose on the AME CONSO website: www.mediationconso-ame.com

    - or by mail addressed to AME CONSO, 197 Boulevard Saint-Germain - 75007 PARIS.
